To maintain our reputation as a museum-grade digital platform, we adhere to strict standards of artistic quality, local authenticity, and professional integrity.This document outlines the benchmarks required for platform membership, directory placement, and marketplace inclusion.
Intellectual Property Boundaries and Cross-Licensing Agreement
1. Retention of Creator Ownership: Independent artists, studios, and galleries ("Creators") who submit, upload, or provide portfolios, text, photographs, biographical data, or images of physical artwork to SaintPetersburg.org and the Saint Petersburg Art Collective (collectively, "the Platform") retain 100% of their underlying copyrights, intellectual property rights, and title to their creative works. Registration or display on the Platform does not transfer ownership of any physical or digital artwork to the Platform.
2. Grant of Promotional License: By submitting content, applying to the digital registries, or listing items for sale on the Platform, the Creator hereby grants the Platform a non-exclusive, worldwide, royalty-free, perpetual, and sublicensizable license to display, host, cache, reproduce, format, distribute, and utilize the submitted media, text, and images. This license is granted strictly for the purposes of operating, cataloging, indexing, publicizing, and marketing the Platform, its digital exhibitions, and the local creative ecosystem across digital media, social networks, and promotional archives.
3. Warranties of Originality: The Creator represents and warrants that they are the sole owner of all intellectual property rights in the submitted content, or possess the express written authorization from the copyright holder to grant this license. The Creator agrees to hold harmless and indemnify the Platform from any third-party copyright, trademark, or right-of-publicity claims arising from media submitted under their profile.
Descriptive Use and Fair Use Trademark Safeguard
1. Descriptive Geographic Identification: The term "Saint Petersburg" as utilized across SaintPetersburg.org and by the Saint Petersburg Art Collective (collectively, "the Platform") is used purely in its geographic, descriptive, and spatial capacity to accurately index, identify, and catalog the working artists, physical studios, independent galleries, and community cultural events operating within the physical boundaries of Saint Petersburg, Florida.
2. No Trademark Infringement or Monopolization: The Platform asserts its formal rights under United States Trademark Law (including 15 U.S.C. § 1115(b)(4)) regarding statutory Fair Use. The geographic descriptive use of the city's namesake is not intended to, nor does it, function as a trademark or source-identifier for any commercial brand, city government municipality, or official corporate enterprise.
3. Intellectual Property Boundaries: All third-party trademarks, municipal symbols, trade names, or district designations (e.g., "Warehouse Arts District") referenced on this site remain the exclusive property of their respective owners. Their appearance on the Platform is strictly for informational, educational, and descriptive reference purposes under fair use doctrine. It implies no sponsorship, commercial partnership, corporate endorsement, or reciprocal sanction by the trademark holders.

In alignment with our corporate charter as a Florida Social Purpose Corporation (SPC), our primary mandate is the economic and cultural elevation of our local creative ecosystem.Local Footprint Required: Membership is strictly reserved for independent artists, working studios, and commercial galleries that maintain a permanent physical presence within the greater Saint Petersburg / Pinellas County region.No Commercial Imports or Mass Production: We do not allow mass-produced commercial decor, third-party drop-shipped items, or imported factory goods. Every piece of art listed on our platform must be designed, fabricated, or directly curated by a verified local member.
2. Structural & Professional Standards
To ensure that the platform remains a premium asset for high-end collectors and institutions, members must meet the following professional criteria:The Interview Requirement: We do not offer automated, instant profile generation. Every artist, studio, and gallery profile is built upon real-world source material and direct interviews conducted by our editorial team to guarantee authentic biographical profiles.Documentation Quality: Visual presentation is the cornerstone of our platform. All portfolio imagery submitted for the Showcase or Shop Collective must be high-resolution, professionally lit, sharply focused, and free of distracting watermarks, date stamps, or cluttered backgrounds.Originality & Intellectual Property: All works must be original creations of the artist or legally represented by the exhibiting gallery. We maintain a zero-tolerance policy for plagiarism, unauthorized replicas, or copyright infringement.
3. Content Boundaries, Nudity, and Artistic Expression
We fiercely defend artistic freedom and recognize that the human form, social commentary, and challenging themes are foundational elements of fine art. However, to maintain our civic status as a trusted regional directory, we draw a clear line between fine art and explicit or malicious material.Fine Art Nudity vs. Explicit Content: Elegant, intentional representations of the human form—including painting, sculpture, and fine art photography—are welcome. However, content that is purely pornographic, explicitly sexual, or exploitative is strictly prohibited.Malicious or Deceptive Content: We will not host content that promotes hate speech, targeted harassment, discrimination, graphic real-world violence, or illegal activities.Political and Social Commentary: Conceptual, political, and social art is protected and welcomed, provided it adheres to our standards of mutual respect and does not cross into targeted defamation or harassment.
4. Operational & Community Conduct
Membership on SaintPetersburg.org is a privilege reserved for professionals who respect the collective community. We expect all members to maintain professional standards in their digital and physical interactions.Honest Representation: Artists and galleries must accurately represent the medium, dimensions, condition, and availability of all artwork listed in the Showcase or Shop Collective.Calendar Integrity: The Events section is reserved for genuine, verified arts programming (e.g., gallery openings, open studio nights, artist talks, workshops). Spamming the community calendar with repetitive, non-arts-related commercial advertisements is prohibited.Transaction Reliability: For members utilizing our Shop Collective hosted checkout, prompt shipping, secure packaging, and reliable fulfillment are required to maintain active selling privileges.
5. Right of Refusal and Appeal Process
SaintPetersburg.org is a heavily curated, invitation-and-vetting-based platform.Absolute Discretion: The editorial board of Saint Petersburg | Art Collective (SPC) retains absolute discretion over the acceptance, rejection, suspension, or removal of any artist profile, gallery listing, event submission, or artwork.Review Requests: If an application is deferred or a listing is removed for failing to meet these standards, creators may request a formal clarity review or submit updated documentation by contacting our curation team directly.
